Islamabad – Islamabad High Court (IHC) has dismissed a petition challenging the special court for treason trial of former President General Pervez Musharraf under Article 6 of the Constitution.

Justice Noor-ul-Haq N Qureshi rejected the petition claiming that the judges selected for Musharraf’s trial in the special court could be biased as they were amongst those who were suspended in 2007 emergency, the Express Stribune reports.

The petitioner claimed that Justice Faisal Arab, who has been appointed as the head of the special court, would be inappropriate as he had refused to take oath under the Provisional Constitutional Order (PCO) in 2007.

He further added that another judge in the special court panel, Justice Yawar Ali, was the nephew of Justice Khalil-ur-Rehman Ramday, who had also been affected by the November 2007 emergency.

Earlier, the IHC registrar office had raised objection to the petition saying that it should seek relief from the apex court.
